Designing A Formal Textualist Theory Of Statutory...
Can a corrective approach to Scrivenerââ¬â¢s Error find conceptual room in a formal textualist theory of statutory interpretation? 1. Introduction. 2. The incompatibility of correction in intent-skeptical textualism. i) A negative account approved: Siegelââ¬â¢s axiom. ii) A positive account rejected: Manningââ¬â¢s attempt. 3. The incompatibility of non-intent-skepticism and faithful agency: a response to Ohlendorf. i) Getting Raz wrong: a theory built on sand. ii) Getting Raz right: in support of skepticism. 4. Conclusion. 1.Introduction This essay will conclude there is no conceptual room for a corrective approach to scrivenerââ¬â¢s error in a textualist theory of statutory interpretation. To do so I will seek to establish two main premises, from which necessarily follows my conclusion: The first main premise states that an error cannot be judicially corrected in an intent-skeptical theory of textualism. I will establish this by supporting Siegelââ¬â¢s axiomatic rejection of correction and by critiquing Manningââ¬â¢s attempt to find justification for correction in textualism. The second main premise states that conceptions of textualism that employ non-intent-skepticism in order to correct errors do so in contravention of the core textualist principle of faithful agency: therefore non-intent-skeptical justifications are not rightly textualist. By way of example of the pitfalls of attempting to reconcile non-intent-skepticism with faithful agency I will examine what I consider the most
Community Based Disaster Risk Management free essay sample
Items such as emergency lights become flesh-devouring acid pools, yet only appearing as wet spots n walls. The severe dust, which is thick and annoying, contains every disease that has been safely buried for the past few hundred years Just waiting to find a nice warm moist home in your lungs. Your only defense from the hostile environment, in which you, the rescuer, will be thrust into, is the personal protection equipment. This equipment must be kept with the rescuer at all times, no matter what! The minimum personal protection gear is: Hard Hat preferably a climbing / rescue helmet. Safety Goggles will be worn for long periods, must be comfortable. Work Gloves at least double leather. Dust Mask preferably cartridge type respirator. Sturdy boots must provide ankle support. Coveralls good quality to provide another protection barrier. Whistle for reliable communication of distress. Duct Tape for securing hazards and everything else imaginable. First Aid Kit compact kit with large pressure dressing, minor wound care, disposable resuscitation shield, etc. Flashlight good quality with lots of batteries and spare bulbs Flagging tape marking routes, hazards etc. This is the minimum gear [see appendix] required. A small fanny pack will probably be required to keep the gear handy and available. The Rules: Some rules of conduct have been created to promote survival in structural collapse. But these are not replacements for sound rescue knowledge and competent training. A short list of rules and explanations follows. The Do Rules turn off the electricity. After a structural collapse the integrity of a buildings electrical system will be severely compromised. What was ground may now be hot, breakers wont blow and electrical fires can start at any time. Not to mention live wires will be hanging everywhere. Learn how to shut off all types breakers. There are many types of systems but here re a few guidelines: -Never look directly at the switch / breaker as you turn it off, the possible arc may blind you. Use your non-dominant hand in case a charge attempts to energize your arm, turning it into a Jelly-like instrument for some time. Place your other [dominant] hand behind your back to prevent completing a circuit to ground, a very nasty situation indeed. Turn off ALL local breakers [the small ones] prior to shutting tontine main breakers. This prevents a massive surge to current occurring when the main breakers are turned off thus reducing the chances of arc burns and/ r electrocution . Ensure the ground / floor youre standing on is dry and clear of debris, if not make it so before touching the breakers. Try at all costs not to touch, the actual metal of the box the breaker[s] are housed in. If you can not avoid touching the housing [I. E.. To open housing door] dont do it with a bare hand. check for flammable gases in the electrical area prior to throwing any switch. DO Turn Off The Water. Learn the many types of water main valves. It is vital to turn the water off as soon as possible, as the lower parts of a building may have become holding ankhs with trapped victims being drowned in a water-filled coffin. Turn the water off as close to the city main as possible [at curbside] in case the supply from the street to the building is ruptured. This may soon create a never-ending lake attempting to swallow the very s tructure you are about to penetrate. Finding the correct tool [many types] to shut off the main will be difficult, one may have to be improvised. The direction to turn the shut off is clockwise, but turn it very slowly to prevent a water hammer from developing. A water hammer may rupture a weak city main further up the line. DO Turn Off The Gas. Turn off all gas / fuel supplies to the building as close to the supply main as possible [street level]. -Use a non-ferrous wrench [non-sparking] designed for the purpose. Most gas valves are turned off by turning the valve 90 degrees, this places the straight of the valve against the direction of the gas pipe. DO Disconnect Telephone Cables. The Telephone Company will probably hate you but damaged lines may be incorrectly energize, or worse, charged via the power lines. This may lead to electrical hazards and fires in the structure. Use extreme caution with the telephone connections, have a qualified errors check for dangerous voltages p rior to getting the wire cutters out. Put up a large sign indicating the lines have been disconnected and where. Discuss the operation of disconnection with the Rescue Chief prior to disconnection in case the telephone system is been used to communicate to the trapped persons in the building. Keep in mind risk verses benefit. DO Mark Routes. Mark all routes to safety [triage area] for both rescue team and walking wounded. In case of structural stability loss, a well-marked route, as free from hazards as possible, will become a life line. A spray can of bright paint will prove invaluable in marking and labeling the route. Use different colors for different teams. DO Mark Hazards. Identify all hazards, possible hazards, and unknown wet spots, etc. , and mark them well. Use spray paint and flagging tape, lots of it, to prevent anyone from unexpectedly walking into hazards. Log all hazards in the teams notes so that in the 3rd rescue stage the teams will be aware of them. Eliminate any hazard if feasible, such as padding sharp protruding objects or duct taping fractured windows. DO Check All Doors. Check all doors all the time. The structure may shift during the course of the rescue so check the door overtime before attempting to open it. Check for heat, use the back o f your hand. Check the sound of the door, tap it if it doesnt have a dull thud sound its probably loaded [load bearing]. Opening it could cause the load from the floor above to meet you on your level so to speak. If the door is loaded mark it and log it as a hazard. Practice door checks on loaded and unloaded doors regularly, it may save your life. If a previously unloaded door becomes loaded, reassess the structure and prepare to rapidly evacuate. DO Mark Room Corners. Spray paint the floor and ceiling corners of safe and possibly unsafe rooms. If the structure shifts the paint will show movement. The practice of marking the corners acts as a DANGER warning but must be checked on a regular intervals for it to work. Assign someone to log and check all markings at set time periods. DO Check Closed Air Spaces. All closed air spaces [basements, manholes, etc. ] must !!!! Be checked with an Air Sampler {sniffed} to ensure there is enough Oxygen and dangerous gases are not present. If an Air sampler is not available, ventilate the area with fans and use extreme caution. If the above can not be carried out then only proceed with Self Contained Breathing Apparatus [S. C. B. A. ]. After a good shake trapped gases will find their way into closed tart spaces.

Financial Management Principles Essay Example
Financial Management Principles Essay Example Financial Management Principles Essay Financial Management Principles Essay Financial Management Principles The time value of money is concept showing a given amount of money is worth more in the present than what the same amount would at after a given duration. This is made possible by the interest earning capacity of money. If one were given the option whether to receive a hundred dollars right now or have to wait a couple of years to receive the same amount, the most reasonable option would of course be the first option. The reason being that one would do a lot with the money now than when one was given after a couple of years. Currently numerous investment options that would take would result in the hundred dollars earning interest to a larger amount by the time the few years are past. For the given situation, the time value of money would come about in consideration on whether the capital invested and the expected income after a given amount of time would be equal if the same amount were invested in another project. : The concept of time value of money would help us as division managers to make the most prudent decisions on which projects to fund and which ones to neglect. There are those projects that seem enticing but when the time factor is put into consideration, it reveals the interest capital accrues over a given time is far much less. Given the above situation, it would be prudent to calculate the exact amount of profit the project is projected to generate. The profit generated is then compared with the capital and the interest accrued on the capital calculated. This interest on capital is calculated in consideration with other factors like taxation, market changes et al. if the interest in capital accrued is reasonable enough in that it is the equal to or above if the capital were invested elsewhere, and the option is then taken as a feasible option. Businesses reach a time when they need to expand hence the requirement of additional capital. The sources of this additional capital are mainly two. These are either to borrow money from the lending sources or sell a piece of the business entity as a form of stock or equity. Regardless of the option the manager opts for, he is going to incur debt and will result into paying interest on the debt incurred. The weighted average cost of capital is a formula used to know which of the options above is best of the business entity. It involves calculating the average for the two sources is weighted in accordance with the amount that the business entity utilizes in funding for its activities (Keane, 1996). The weighted average cost of capital is based on the formula that the weighted cost of capital is the equivalent of the addition of the proportion for the debt financing. This summation is later multiplied by the charge incurred in equity capital. This is then multiplied with the proportion of equity financing. The result will enable me as the division manager to identify the most feasible option. The option giving the lowest cost of capital will mean it is the best to run the business in profitability. The weighted average is a good way of identifying the most feasible source of additional income that will not have the business entity to incur unnecessary expenses in paying up interest on loans. The marginal cost in capital is the cost the business entity will incur when there is an accumulation of one dollar of capital. The amount of marginal cost incurred by a business varies according to the capital source selected by the manager. The marginal cost of capital enables me as the division manager to determine the cheapest way of raising capital while maximizing profit. This constraints my choice to those options whose marginal cost on capital is at least equal to the cost incurred by the business in raising the capital. In this sense, it would be unwise to source capital at a cost of say eight percent and invest it in a project that will earn the company an interest of less than eight percent. The basic idea is money borrowed ought to be invested in such a way that it is able to repay itself and the interest accrued (Gallagher, Andrew, 2008). References Gallagher, C. Andrew, K. ( 2008). 1.1 Revised Paper Assignment Example | Topics and Well Written Essays - 250 words
1.1 Revised Paper - Assignment Example However, in America, the situation is different where most women have been empowered and many of them are professionals meaning that they spend little time or no time with their family. The United States being a place that is comprised of many different cultures, it is clear that growing up as a woman in this area has different meaning depending on your cultural background. For example, most Hindu women stay at home to cook for their families and tend to them while the husbands work while in the African American society the women are the most hardworking (Bloustien 110). Therefore, growing up as a woman in these different cultures has taught me many things in the sense that, I have appreciated that a woman is a diverse person regardless of where she comes from or lives. This is because she manages to embrace the different changes that are brought to her by the different cultures. Additionally, adopting and talking up all these roles in the society is not an easy task, but as a woman all a person can do is to embrace them and continue

Sociological Analysis and British Society - Sociological Situations Essay
Sociological Analysis and British Society - Sociological Situations involving Conflicts - Essay Example Sociological conflict is also defined as a confrontation of powers (Rummel 1975), with the power taking many forms and shapes. Power can be identive and assertive, altruistic and manipulative, coercive and physical or even expressive. Rummel (1975) has opined that "power can be intentionally directed, as are as are assertive and bargaining powers; one is directed wholly towards a person's body, as is force; and others are directed through another self, as are inductive and intellectual powers." Ultimately all these powers can have a major impact resulting in a conflict. Several other authors (John and MacArthur 2006) also opined that "social conflict refers to the various types of negative social interaction that may occur within social relationships (e.g., arguments, criticism, hostility, unwanted demands), and may include physical violence." This paper is also forwarded to learn many sociological conflicts involving conflicts that will confront us in the way we think, challenge us to understand, and defend, conflict from multiple viewpoints and to know what exactly happens when ideas, institutions, and diverse actions are viewed from different perspectives (Harvey 2005). The main concern here is of course, understanding and explaining the basics of sociological conflicts; by its basic definition, socia... Thus sociological conflict is in essence confrontation of social powers (Rummel 1975). To critically explain and simply understand, a sociological conflict is an exclusive aspect of social power, and is not entirely limited or restricted to a hostile or antagonistic opposition! In essence, the conflict of intellectual is often "expressed through debating, arguing, or disputing; of bargaining powers through haggling, negotiating, dickering, bartering, or exchanging; of authoritative powers through adjudicating, appealing, or documenting; of altruistic powers through accommodating, obliging, or benefiting" (Rummel 1975). One of the most important points that are to be noted here is that love/affection and conflict can never come together, though persuasive inductive vectors are more common among lovers. Thus, these expressions of conflicts that are altruistic in nature are also called social solidarity (Rummel 1975). Till date, sociological conflicts and its ramifications have been a neglected aspect of social equation in sociological research that concerns the British society. Existing measures usually consists of a small numbers of items that inquire about the frequency and modulation of various types of critically negative social interactions like demands and criticisms; and things that are asked generally with respect to some type of relationships like, spouse and friends (Seeman et al 1994, Schuster et al 1990). Currently available research data shows us that lower the SES, higher will be the sociological conflicts in case of adults, while the same is often true in younger lots, when SES is connected with more traumatic peer relations. More often, sociological conflicts may arise as
